If you have experienced domestic and family violence and are thinking about moving away with your children, it is important to get legal advice.

If you move away with your children without the other parent’s agreement or without a Parenting Order, it is possible for the court to order for your children to move back, or order that your children live with the other parent. Also see Recovery Orders.

If you want to move away with your children and the other parent does not agree, one option may be to make an application to the Family Courts to decide whether the children can move to a new location with you.

It is important to get legal advice if you are thinking about moving.
